Definitions:

• Ozone: Ozone for Digital Marketing Company, registered and established in accordance with the laws of the Kingdom of Saudi Arabia, having Commercial Registry No. 1128184676 or its representative by an authorization issued by the relevant authorities.
• Person: A Natural or Legal person.
• The Platform: The official website, application of Ozone or.( https://www.ozone.social )
• The Service: using the Platform to obtain and/ or provide advertisement services through social media platforms.
• The User: A Person who is registered and authorized to log into the Platform and use it for authorized purposes. this includes the Service Provider, Beneficiary, Platform surfers and visitors.
• The Service Provider: is the User who provide the Service under the applicable laws and regulations and who meets the conditions and criteria for providing Services on the Platform.
• The Beneficiary: is the User who obtain the Service.
• Information: any Information or Data submitted by any person to Ozone through the Platform or the official channels.

REGISTRATION ELIGIBILITY:

by registering in the Platform, User hereby acknowledges meeting the following eligibility criteria:

For the Beneficiary

• To be 18 years of age in the time of registration (for the Natural Person);
• To be licensed to undertake certain activity for which he wishes to obtain the Service under the applicable laws and regulations;
• To provide proof of authorisation for the individual who will be registering and using the Platform on behalf of the Beneficiary;
• To provide identification for the authorised person on the Beneficiary’s behalf.

The Service Provider:

• To be 18 years of age in the time of registration.
• In case of non-fulfilment of the requirement mentioned in 2.2.1 above, the registration shall be by virtue of prior written consent of the parent or the legal guardian and under his responsibility.
• Owning an account on one of the social media platforms.
• Agreeing to Ozone Fees Agreement.

A General requirement for all Users

• to Submit all information required by Ozone. User’s registration in the Platform shall not be accepted if User does not provide or update the required information.
• Ozone reserves the right to decline any registration without further explanation. Ozone reserves the right to undertake such checks as are necessary to verify the identity of both the Service Provider and the Beneficiary and the validity of registration requirements.

Acknowledgment & Permission :

• By registering in the Platform, you grant and permit Ozone and its authorized personnel and particular successors the right to copy, use and distribute any media, photographs or video clips of you which you posted by on your social media pages or that you uploaded to the platform in connection with the Services provided through the Platform, through any publishing means, whether electronic or otherwise, or a means of social media to be used the purposes of advertising and promoting the Platform.
• By registering in the Platform, you also waive the right to inspect or approve all versions of your photographs or recorded appearances in media and videos. You acknowledge that all copies of your images or recorded appearances in media or videos which are taken or recorded for the benefit of Ozone or its customers or was uploaded to the platform will be the intellectual property of Ozone or its customers, including all moral and financial rights.
• Accordingly, by registering on the Platform, you declare that you fully and completely release Ozone and its customers, in the present and future, from any rights or claims of any kind arising from using or publishing your personal photographs, media or video clips for the purposes referred to above, in accordance with all laws and regulations applicable in the Kingdom of Saudi Arabia.

Usage:

• User shall be subject to these Terms and Conditions. accessing or using the Platform shall be construed as an acknowledgment by the User that he is fully informed and accepts to abide by these Terms and Conditions in addition to laws, regulations, decrees and instructions in force in the Kingdom of Saudi Arabia in respect to any activity the User undertakes. and that he alone is responsible for the consequences that may arise from his non-compliance with any of them. This acceptance becomes effective immediately upon first using or accessing the Platform.
• Ozone may suspend, prevent and/or terminate the use of this Portal without notifying the User at its absolute discretion in the event of a violation occurred by the User, or if there are grounds to believe that User has violated these Terms and Conditions or acted in a manner that may be considered by Ozone at its own discretion as illegal or as causing harm to others and non-satisfaction of any current or future regulatory requirements. If any of the previous cases occur, the User will be not authorised to log in the Platform or to benefit from its services.
• Ozone may, at any time, change these terms and conditions. Any further modifications to the terms of use shall be in force a week after issuance date and notification thereof unless otherwise stated from Ozone. Continuing to use and access the Platform shall be construed as User’s acknowledgement and acceptance of such modifications.
• The User agrees and undertakes that any person in charge of executing or requesting any of the services available through the Platform, shall be the authorized person has all legal powers and authorizations necessary to request or execute the Service.
• The User shall submit any data or documents required by Ozone, whether before or after obtaining the service.
• The User acknowledges and warrants the validity and integrity of the information submitted in order to obtain the Service.
• The User shall notify Ozone in writing immediately once any changes are introduced to the submitted Information, including any changes to The User and/or the authorized person, etc.
• Ozone may retract its approval if the application is incomplete.

Restrictions of use:

Restrictions of use: User may use the Platform in accordance with this Terms and Conditions for legal purposes only which include full compliance with all Laws, regulations, rules and practices in force in the Kingdom of Saudi Arabia and in the country in which User’s enter into the Platform, including, but not limited to:

• Full adherence to not use the Platform in a manner that may lead to violation of Ozone rights and/ or to any other third party’s rights.
• Not to send transmit or publish from or through the Platform any information or materials that may be considered as illegal, harmful, immoral or that may defile the reputation of others, or it may be considered so.
• Not to interfere in the operation or work of the Platform, including, but not limited to downloading, or sending damaged files, viruses or any other harmful materials, or using any programmes, methods, or devices that intermesh with the site or cause any kind of disturbance, or taking any measures that may cause unjustified pressure on the site’s infrastructure.
• Not to access or attempt to access to the site without authorization, including the illegal access by using a false password or false PIN/ID number, or attempting spoofing any other person’s identity
• Not to use any technologies or programs to hide the identity or location of the User.
• Although Ozone constantly seeks to update its antivirus programmes, Ozone does not guarantee that the site, its servers, downloaded files, or emails that Ozone send are free from viruses or other threats and harmful components. Therefore, as the User:
• Shall not enter or attempt to enter any virus or any other harmful content to the site, or any of its programmes or systems.
• Shall not attempt in any way to enter, or to change or to reverse the Platform engineering, or destroy, or tamper or abuse or misuse any its programs or its systems.
• The User shall not transfer or waive the Service to any third party.

Intellectual property:

• Ozone owns the rights of all data bases, trademarks, designs, and signs contained in the Platform. no person may copy, reproduce, store, download, send, make use of, modify or use any of the information contained in the Platform in any way whatsoever without the prior written consent of Ozone.
• User hereby authorizes Ozone to use, publish and process content submitted from the User which is subject to copyrights for the purposes of obtaining the Service in accordance with Ozone’s Privacy Policy .
• Intellectual property for advertising content subject of the Service: both Beneficiary and Service Provider agree that the advertising content is considered to be work made for hire for the favour of the Beneficiary. The Service Provider shall not reuse, republish on any mean or benefit from such content in any way with without obtaining a prior written consent form the Beneficiary. .

• The Platform may include links related to third parties’ websites. Ozone shall not be responsible for the information, materials, services or products contained in The Platform or accessible therein or though external links. Therefore, access and usage of these websites shall be made under the User’s own responsibility.

Disclaimer:

• Nothing in these Terms and Conditions will:
• limit any liabilities in any way that is not permitted under applicable law; or
• exclude any liabilities or statutory rights that may not be excluded under applicable laws.
• The User hereby acknowledges and agrees that Using he Platform shall remain at his own risk, and that Ozone shall be considered as an intermediary between the Merchant and Consumer, User further acknowledges that Services provided under the Platform constitute an independent agreement between the Consumer Merchant which is binding upon both of them only, Ozone shall not be responsible in any way for any sums paid, any loss or damage of any kind that the User may incur due to the use of or visit to the Platform or reliance on any statement, opinion or advertisement in the Platform, or obtained through the Platform.
• Ozone makes its best efforts to provide the most accurate and up-to-date information on this Site. However, there may be some errors. Therefore, the user access to this Platform and his use of its programmes and contents shall be at his own sole responsibility, as Ozone provides access to this Site “as it is” and “only at its availability”, and Ozone shall not hold any responsibility for the Site contents, its quality and accuracy. No Competition with Ozone:

• Both Service Provider and the Beneficiary agree that during the Term of providing the Service and for an additional period of one hundred and eighty (180) days from the expiration or termination of the Service, they will not, either directly or indirectly, entering into, or attempting to enter into, a contractual relationship or executing services in way that constitutes a competition to the Service provided though the Platform under this Terms and Conditions.

Applicable Law & Dispute Resultion:

• These Terms and Conditions are subject to the laws and regulations in effect in the Kingdom of Saudi Arabia Both Consumer and the Merchant agree that in the event that any claim or dispute arises due to the use of the Platform or the services provided therein, the exclusive jurisdiction to settle these disputes or claims shall be to the competent judicial authorities in the In Riyadh city, Kingdom of Saudi Arabia.
